1. Heard Mr.Panda, learned counsel for the Appellant and Mr.L.Bhuyan, learned counsel for Respondent Nos. 1 to 4.

2. The substituted service through paper publication on Respondent No.5 is treated as sufficient.

3. None appears on call for Respondent No.5.

4. Upon hearing both parties and perusal of the limitation petition, it reveals that the sole ground taken to condone the delay of 211 days that, the brief was misplaced in the office of the concerned lawyer. The ground is not found satisfactory and the prayer to condone the delay is rejected.

5. The I.A. is dismissed.

6. Consequently, the appeal is dismissed on the ground of limitation.
