Questioning the order dated 3rd January, 2017 passed by the learned S.D.J.M., Jajpur in G.R. Case No. 268 of 2016 declining to hand over custody of the victim girl (Ayesha Sidiqua) to her uncle, namely, Abdul Bari, the Petitioner has approached this Court with a prayer to quash the said order in exercise of power under Section 482 of the Cr.P.C.

Perusal of said order dated 3rd January, 2017 reveals that the learned S.D.J.M., Jajpur has taken into consideration the welfare and security of the victim girl and directed her stay in the short stay home.

On 11th April, 2017, when the matter was called, the same stood adjourned at the behest of the learned counsel for the Petitioner. Till date no step has been taken in this matter. However, when the matter is called today, none appeared for the Petitioner. Since the matter has been pending since 2017, and no one appeared
// 2 // on behalf of the Petitioner, it is construed that the Petitioner is no more interested to pursue this matter.

Mr. Iswar Mohanty, learned Additional Standing Counsel submitted that in F.I.R, the age of victim girl (Ayesha Sidiqua) is stated to be 15 years in April, 2016 and therefore, this matter has been rendered infructuous.

In view of such submission, the CRLMC is dismissed. 6.
A copy of this order be communicated to the Court below forthwith.
