Against the Petitioner No.1, a partnership firm of Petitioners No.2&3, for default in payment of installments of loan of Rs.10,10,000/- availed by the firm during the year 2011 from UCO Bank, Basanti Colony Branch, Rourkela (Opposite Party No.1), recovery process under SARFAESI Act, 2002, was initiated by issuance of a demand notice and symbolic possession notice U/s 13(2) and U/s 13(4) of the SARFAESI Act, 2002 respectively. By filing the present petition challenge has been laid to the demand notice dated 8th October, 2013 and the symbolic possession notice dated 24th December, 2013.

At the time of hearing, counsel for the Parties are agreed that nothing more survives for adjudication in the present writ petition, as the loan account has been closed upon deposit of the outstanding liabilities.
