This matter is taken up by virtual/physical mode. 2.

The Petitioner is before this Court challenging the E-Auction sale notice dated 18th December, 2021(Annexure-5). 3.

Having not been able to satisfy the demand of Rs.58,40,900.13 made by the Bank of India, E-Auction sale notice has been issued and date was fixed to 25th January, 2022, consequent upon the notice dated 2nd September, 2021 U/s 13(2) of the SARFAESI Act, 2002 and symbolic possession being taken on 26th November, 2021 U/s 13(4).

It is submitted by the counsel for the Petitioner that on the said date, i.e. 25th January, 2022, E-Auction sale could not be held. Hence, the Petitioner seeks permission to withdraw the writ petition. P.T.O.
