1. This matter is taken up through hybrid mode.
2. Learned counsel for the parties are present. Judgment prepared in separate sheets is delivered and pronounced in open Court in the presence of learned counsels for the parties and the order is passed accordingly as follows:-
3. Therefore, this Court is not inclined to interfere with the order dated 20.01.2022 as the learned Presiding Officer, Special Court under the S.C. & S.T. (PoA) Act, Cuttack has rightly rejected the petition filed by the appellant under Section 167(2) of the Cr.P.C. seeking for his default bail.
4. So far as the prayer of the appellant for release on bail is concerned, taking into account the nature and gravity of the accusation, character of evidence appearing against the appellant, the
// 2 // stringent punishment provided and that there are no reasonable grounds for believing that the appellant is not guilty of the offences alleged or not likely to commit any such offences, which is not possible to record in this case, the prayer for bail is devoid of merit.
5. Accordingly, the CRLA is dismissed.
