This matter is taken up through hybrid mode.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order taking cognizance dated 26th June, 2008 passed by the learned S.D.J.M., Bhubaneswar in I.C.C. No.2710 of 2008. 3.

No one appears on behalf of the Petitioner when the matter is called.

In the meanwhile, the Opposite Party No.1-Complaint has already died.

Be that as it may, the aforesaid complaint petition has become infructuous.

Since no one appears on behalf of the Petitioner, this CRLMC stands dismissed for non-prosecution.

However, Petitioner is at liberty to approach the trial court in view of the death of the Opposite Party No.1-

// 2 // Complainant and the trial court, if found that the Opposite Party No.1-Complainant has died in the meanwhile, shall drop the proceeding.
