The grievance of the Petitioner in this Writ Petition is that the Petitioner is a rice mill owner and regularly paying the energy bill, but subsequently a demand of Rs.62,96,839/- was raised and he was threatened for disconnection of the electricity connection to the rice mill by issuing notice, vide Annexure-1. The Petitioner on receipt of the same made a representation vide Annexure-3 and also paid Rs.14,96,838/- and prayed to allow him to pay the balance amount in instalments but without disposing of the said representation, notice of threat for disconnection of the power supply having been issued, the Petitioner has come to this Court for quashment of the said notice and also allow him to pay the amount in instalments.

Mr. Tripathy, learned counsel for the opposite parties, submits that the notice for disconnection of electricity issued to the rice mill has already been withdrawn and the Petitioner has been allowed to deposit the balance electricity dues to the distributing company in instalments.

In view of such submission of Mr. Tripathy, learned counsel for the distribution company, nothing survives in this Writ Petition.

However, it is made clear that if the Petitioner is otherwise aggrieved by fixation of instalments, he may file a fresh representation to the distribution company in this regard and in that event, the distribution company shall dispose of the same within a month thereafter and communicate the decision to the Petitioner within ten days of such decision taken to enable him to challenge the same in appropriate forum, if so aggrieved.

Giving such liberty to the Petitioner, this Writ Petition stands disposed of.

Urgent certified copy of this order be granted on proper application.
