This matter is taken up through Hybrid mode.

The petitioners in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") have prayed for quashing of the F.I.R. in Rupsa P.S. Case No.45 of 2009, so also the consequential proceeding in C.T. Case No.2051 of 2009 relating to I.C.C. No.634 of 2009, pending on the file of the learned S.D.J.M., Balasore.

Considering the facts and circumstances of the case, this Court is not inclined to allow the prayer made in this CRLMC. However, this Court observes that since the chargesheet in this case has already been filed and the cognizance of the offence has already been taken against the petitioners, if the petitioner so aggrieved, may seek for appropriate remedy before the appropriate forum, if aggrieved by the same.
