The petitioner in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") has prayed for quashing of the order dated 14.08.2009 passed by the learned J.M.F.C., Puri in 1.C.C. No.125 of 2006 framing charge under Sections 419 and 420/34 of IPC against him. 3.

Learned counsel for the petitioner seeks for an adjournment of this case on the ground that the File is misplaced. Such ground was also taken on 25.02.2022. 4.

Since this case is of the year 2011 and one decade has been passed from the date of filing of this case, this Court is not

// 2 // inclined to adjourn this matter further on the aforesaid ground. Hence, this CRLMC stands dismissed for non-prosecution. 5.

However, liberty is given to the petitioner to raise all his defence before the trial Court at the time of trial and in that event the trial Court shall decide the same in its own merit. 6.

A copy of this order be communicated to the Court below forthwith.
