This matter is taken up through hybrid mode.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the criminal proceeding/F.I.R. in Brajrajnagar P.S. Case No.120 of 2011, corresponding to G.R. Case No.884 of 2011, pending in the Court of S.D.J.M., Jharsuguda.

No one appears on behalf of the Petitioner when the matter is called.

The case is of the year 2011 and the present status of the case is also not known.

As such, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter.

Hence, this CRLMC stands dismissed for nonprosecution.

However, if the case is still subsisting and charge sheet in this case has been filed, the Petitioner may seek quashment of the cognizance/charge, if framed, if so advised. 8.

Interim order dated 28th October, 2011 passed by this Court in Misc. Case No.2200 of 2011 stands vacated. 9.

A free copy of this order be handed over to the learned counsel for the State for its communication to the concerned Police Station.
