1. Mr. Mohapatra, learned counsel for the Petitioner informs the Court that the Petitioner has died. Since the Petitioner has died and the challenge is to the order imposing penalty on him under the RTI Act in his personal capacity, and considering that said order has been stayed by this Court for over 11 years now, this Court does not consider it appropriate to burden his family with the said liability. Accordingly, the impugned order dated 28th May, 2011 passed by the State Information Commission in S.A. Case No. 263 of 2008 is set aside.

2. The writ petition is disposed of.
