Considering the averments made in the application itself and after hearing learned counsel for the petitioner, the order dated 04.02.2022 passed in W.P.(C) No.2325 of 2022 is recalled and fresh order is passed in W.P.(C) No. 2325 of 2022.

Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking direction to the opposite parties to give him antedate promotion to the post of Jr. S.E.S. w.e.f. 1992 as per Rules 10(A) and 10(B)(2) of O.S.E.S. Rules and resolution dated 09.01.1996, letter dated 12.01.1996, 02.01.2002, 01.09.2012, 25.10.2012, 26.02.2013, 12.06.2013, 03.10.2013 recommendation dated 03.01.2011 and 07.02.2014 and in the light of order dated 16.09.2016 and the order dated 03.09.2021, 29.09.2021 and 23.12.2021 w.e.f. 1992 with all consequential service benefits. 4.

In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made representation to opposite party no.2 vide Annexure-11 and the same may be directed to be considered within a stipulated time taking into consideration Annexure-13, to which learned State Counsel has no objection. 5.

As agreed by the learned counsel for the parties, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing opposite party no.2 to consider the representation filed by the petitioner vide Annexure-11 and pass appropriate order in accordance with law within a period of three months taking into consideration Annexure-13 from the date of production of certified copy this order.

Issue urgent certified copy as per rules.
