It is stated by the learned counsel for the petitioners that in the meanwhile the deceased petitioner having already died and this matter has become infructuous, inasmuch as the deceased petitioner had challenged a proceeded under Section 107 of Cr.P.C. against him.

In view of such submission, this CRLMC stands dismissed being infructuous. Consequently, the proceeding under Section 107 of Cr.P.C. against the deceased be dropped.

A copy of this order be communicated to the learned SubDivisional Magistrate, Puri forthwith. (S. Pujahari) Judge MRS
