Heard Mr. B. Pujhari, learned counsel for the petitioner and Mr. S.K. Pattnaik, learned Senior Counsel for the Opposite Party-OFDC.

The present writ petition is being pursued by the LRs of Mr. Abhimanyu Dalai (died) assailing order of recovery under Annexures-7 and 9.

During the course of hearing, learned counsel for the petitioner has placed on record a communication issued by the Chairman-cum-Managing Director of OFDC Ltd., inter alia
indicating closing of all audit paras involving recovery etc. in case of employees who died in service or after retirement before recoveries on account of these audit were effected. 5.
It is submitted by the learned counsel for the petitioner that the recovery in question is covered by the communication of the Chairman-cum-Managing Director dtd. 21.02.2004 adverted to above.

In view of such submission, the cause of action no longer survives and the writ petition is disposed of giving liberty to the parties to move this Court afresh in the event there is any change of circumstances.

Accordingly, the Writ Petition stands disposed of. 8.
