This matter is taken up through virtual mode. 2.

The Petitioner apprehending his arrest in Kujanga P.S. Case No.120 of 2011, corresponding to G.R. Case No.284 of 2011, pending in the Court of J.M.F.C.(P), Kujanga, registered for alleged commission of offences punishable under Sections 498-A, 323. 506 read with Section 34 of the I.P.C. and Section 4 of the Dowry Prohibition Act, has filed this petition for his release on pre-arrest bail. But, charge sheet under Sections 498-A, 323, 406, 506 read with Section 34 of the I.P.C. and Section 4 of the Dowry Prohibition Act has been filed against the Petitioner.

Heard the learned counsel for the Petitioner and the learned counsel for the State.

Since it is a case of the year 2011 wherein N.B.W. has already been issued against the Petitioner and the Petitioner

// 2 // now coming to this Court seeking pre-arrest bail, this Court is not inclined to entertain the prayer made by the Petitioner at this stage.

However, if the Petitioner surrenders and moves for bail before the Court in seisin over the matter and in that event, the Court in seisin over the matter shall consider and dispose of the bail application of the Petitioner in accordance with law on the same day taking note of the release of the co-accused, if any, in this case.

However, the aforesaid order should not be construed as a protection from arrest till the date of surrender. 7.

As restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout copy of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020 as modified by Court's Notice No.4798, dated 15th April, 2021 and Court's Office order circulated vide Memo Nos.514 & 515 dated 7th January, 2022.
