1. This application has been filed by the petitioner under Section 407 of Cr.P.C. for transfer of G.R. Case No. 209 of 2009 pending in the Court of the learned S.D.J.M., Berhampur, to the Court of learned S.D.J.M., Bhubaneswar.

2. Notice had been issued to the opposite party nos.2 and 3. None appears for the petitioner or opposite party nos.2 & 3 when the matter is called even though counsels have filed Vakalatnama on their behalf.

3. As the G.R. Case sought to be transferred is of the year, 2009 and 13 years have elapsed in the meanwhile, no useful purpose would be served by keeping this TRP(CRL) pending.

4. This TRP(CRL) is accordingly dismissed.

5. Urgent certified copy of this order be granted on proper application.
