Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 28.11.2021 in connection with Talcher P.S. Case No. 518 of 2021 corresponding to G.R. Case No. 2240 of 2021 pending in the court of learned S.D.J.M., Talcher for the alleged commission of offence under Sections 498-A/304-B/306 of IPC read with Section 4 of the Dowry Prohibition Act.

The petitioner is the husband of the deceased, whom he had married six months prior to the alleged occurrence. There are materials to show that the petitioner used to assault his wife in an intoxicated state and demand dowry.

Considering the nature of allegations and the existence of materials prima facie in support thereof, I am not inclined to allow

the prayer for bail at this stage, which is therefore, rejected. It is open to the petitioner to renew his prayer after examination of one Guna Khatua and other material witnesses. Further, learned trial court shall do well to expedite the trial, if there is no other impediment.

The BLAPL is accordingly rejected.
