The matter is taken up through hybrid arrangement Order No.

(virtual/physical) mode.

This is the second journey of the Petitioner who is in custody in connection with Kantamal P.S. Case No.108 of 2017 corresponding to C.T. Case No.492 of 2017 pending on the file of learned Addl. Sessions Judge, Kantamal, for alleged commission of offence under Section -20(b)(ii)(C) of the N.D.P.S. Act, in filling this application under section 439 of the Cr.P.C. for reconsideration of his prayer for grant of bail to the Petitioner in the above mentioned case.

Learned Counsel for the Petitioner prays for withdrawal of this Application seeking liberty for the Petitioner to move the Trial Court afresh by citing all the developments which have taken place in the meantime; including the factum of grant of bail to the co-accused persons for their consideration in proper perspective.

// 2 // It is needless to mention here that in the event, such a move is made, the Trial Court would do well to consider the matter on merit; further taking into account all such subsequent developments which have taken place in the meantime in their proper perspectives and disposed of the same early in accordance with law.

The BLAPL is accordingly disposed of.

Issue urgent certified copy as per rules.
