Undisputedly the proceeding vide Encroachment Case No.5 of Order No.

2021 is already closed in the meantime. As there is payment of penalty by the Petitioner as clearly appearing at page 17 of the brief on determination that the Petitioner is an encroacher and also keeping in view the clear provision at Section 8-A of the O.P.L.E Act, this Court finds no scope to direct for considering the application vide Annexure-3.

The writ petition is accordingly dismissed.
