CORAM:

THE CHIEF JUSTICE JUSTICE R.K.PATTANAIK Order No.

ORDER

19.07.2022 04.

1. The limited ground on which the Petitioner-Workman has challenged the impugned award dated 11.03.2013 passed by the Labour Court, Bhubaneswar in I.D. Case No.75 of 2002 is that despite finding the termination of services to be illegal and ordering reinstatement the Labour Court has given an inadequate compensation of just Rs.20,000/-.

2. This Court has heard learned counsel for the parties. It is seen that admittedly, the workman was engaged from 1st April, 1992 till 23rd August, 1999 which is a period of about seven years. He was working as a Clerk-cum-Supervisor. In the circumstances the compensation for illegal dismissal could not have been as low as Rs.20,000/-.

3. In the considered view of the Court, the interest of justice will be served if the management is directed to pay a further

// 2 // sum of Rs. 30,000/- to the Petitioner as compensation. It is so ordered. The total amount of Rs. 50,000, less the sum if any already paid, be paid by the opposite Party to the Petitioner Workman within a period of eight weeks from today.

3. The writ petition is disposed of in the above terms. (Dr. S. Muralidhar) Chief Justice ( R.K.Pattanaik) Judge kabita
