Since the present writ petition has been filed seeking direction to the opposite parties no.1 to 3 for grant of recognition in accordance with Section 15 of Orissa Nurses and Midwifes Registration Act, 1938 for the year 2007, by efflux of time, the writ petition has become infructuous.

Mr. G.R. Sethi, learned counsel for the petitioner contended that by virtue of notification dated 06.09.2021 issued by the Directorate of Medical Education & Training, Odisha, consent for University Affiliation shall be issued to the Nursing Education Institutions having NOC issued by ONMRC, in view of the order passed by the apex Court in the case of Karnataka State Association of the Management of Nusring and Allied Health Science Institutions and others Vrs. Indian Nursing Council and others (Civil Appeal No. 12759-12761 of 2017 arising out of SLP (Civil) Nos. 23346-23348 of 2017 disposed of on 11th September 2017 and also the subsequent order passed on
11.09.2017 in the said applications.

In view of such position, this Court is not inclined to entertain this writ petition. However, it is open to the petitioner to pursue his remedy before the appropriate forum in terms of the aforesaid notification, if he is so advised.

With the aforesaid liberty, the writ petition stands disposed of.
