This matter is taken up through hybrid mode.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order dated 6th November, 2007 passed by the learned S.D.J.M., Koraput in G.R. Case No.650 of 2006, taking cognizance of offences under Sections 376, 313, 506, 109 read with Section 34 of the I.P.C. and Section 3(2)(v) of the S.C. & S.T. (PoA) Act.

No one appears on behalf of the Petitioner when the matter is called.

The case is of the year 2011.

As such, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter.

Hence, this CRLMC stands dismissed for nonprosecution. 7.

Interim order dated 3rd August, 2011 passed by this Court in Misc. Case No.1542 of 2011 stands vacated. 8.

Order be communicated to the court concerned forthwith.

The original statement of the Opposite Party No.2 recorded under Section 164 of Cr.P.C. which forms part of the record be sent to the court below immediately by registered post with A.D. by sealed cover in an appropriate manner and it will be ensured that the same shall be reached to the court concerned.
