The petitioner has filed this writ petition seeking direction to opposite parties to grant Trained Graduate scale of pay in favour of the petitioner on attaining the age of 48 years with effect from 10.07.2017 as per the decision of Radharani Samal v State of Orissa, 2017 (1) ILR-CUT-546, since the same has already been disbursed in favour of other similarly situated employees.

In course of hearing, learned counsel for the petitioners states that highlighting the grievances, the petitioners have made a representation to opposite party No.1 vide Annexure-7 and the same may be directed to be considered within a stipulated time, taking into consideration Annexures-5 and 6, to which learned counsel for the State has no objection.

As agreed to by learned counsel for the parties, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing opposite party No.1 to consider the representation filed by the petitioner vide Annexure-7, taking into consideration Annexures- 5 and 6, and pass appropriate order in
accordance with law within a period of three months from the date of production of certified/authenticated copy this order. 6.
As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed, vide Court's Notice No.4587 dated 25th March, 2020, as modified by Court's Notice No. 4798 dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
