None appears for the petitioner at the time of call. Heard learned Additional Government Advocate for the State. Perused the record. 3.

The petitioner files this writ petition seeking direction to the opposite parties to restrain themselves from deducting the Cess from the running account bills of the petitioner and to refund the amount already collected towards Cess along with interest @ 18% per annum. 4.

The dispute raised by the petitioner is pertaining to the execution of work of the year 2009. None is also there to prosecute the case. At this stage, this court is not inclined to entertain the prayer made in this writ petition. However the petitioner is at liberty to pursue his remedy before the appropriate authority, if any cause of action still survives. 5.
