1. Considering that the impugned order of the Additional Tahasildar, Bhubaneswar dated 20th May 2002 in W.L. Case No.763/70 and M.C. No.869/2000 is an appealable one, learned counsel for the Petitioner is permitted to withdraw the present petition to approach the appellate authority in accordance with law.
2. Learned counsel for the Petitioner states that she is not aware if the Petitioner, who was 78 years at the time of filing of the present petition, is still alive. The permission above granted is also available to the legal representatives of the Petitioner in such event.
3. If the appeal is filed not later than 2nd May 2022 accompanied by an application of condonation of delay citing the pendency of the present petition as a reason for delay, it will be considered on merits by the appellate authority. The status quo order passed by this Court on 6th August 2012 will continue till such time the
appellate authority passes an appropriate order on an application for interim relief to be filed along with the appeal within aforementioned time.
4. The writ petition is disposed of in the above terms.
