1. Learned counsel for the Petitioners seeks leave to withdraw the present writ petition with liberty to file an appeal against the impugned order of Tahasildar, Banki in accordance with law. If such an appeal is filed not later than 9th May, 2022 accompanied by an application for condonation of delay, giving the pendency of the present petition as the reasons for the delay, it will be considered by the Appellate Authority in accordance with law.
2. The Interim order passed by this Court on 26th April, 2011 will continue till such time the Appellate Authority passes an interim order on an application filed for such relief along with the appeal provided it is filed within the time stipulated. The Appellate Authority will proceed after hearing the present Petitioners or any other persons who may be interested in the plot in question. The Court clarifies that it has expressed no view on merits.
