This matter is taken up by video conferencing mode. 3.

The petitioner has filed this application seeking direction to the opposite parties no.1 and 2 to approve his promotion to the post of Senior/UD clerk in respect of Kesinga Mahavidyalaya, Kesinga in the district of Kalahandi and to grant and release all the arrear consequential service and financial benefits with effect from 01.03.1992 within a stipulated time.

In course of hearing, learned counsel for the petitioner states that the petitioner has already made representation before opposite party no.2 vide Annexure-7, and the same may be directed to be disposed of taking into consideration the judgment of this Court in the case of Rajendra Prasad Singh v. State of Orissa and others, 2001 (II) OLR 683 within a stipulated time, to which learned State Counsel has raised no objection.

As agreed by learned counsel for the parties, without expressing any opinion on the merits of the case, this writ

petition stands disposed of directing opposite party no.2 to consider the representation filed by the petitioner under Annexure-7 taking into consideration the judgment of this Court in the case of Rajendra Prasad Singh v. State of Orissa and others, 2001 (II) OLR 683, and pass a reasoned and speaking order as expeditiously as possible, preferably within a period of three months from the date of receipt of the certified/authenticated copy of this order. As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed, vide Court's Notice No.4587 dated 25th March, 2020, as modified by Court's notice no. 4798 dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
