The petitioner in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") has prayed for quashing of the order dated 08.08.2011 passed by the learned Special Judge, Vigilance, Bhubaneswar in T.R. No.19 of 2008 framing charge under Section 13(2) read with Section 13(1)(d) of the P.C. Act against him. 3.

None appears for the petitioner. Mr. Pani, learned senior standing counsel appearing for the Vigilance Department is present.

Since no one appears for the petitioner at the time of call and this case is of the year 2011 and one decade has

// 2 // already been passed from the date of filing of this case, this Court is of the view that the petitioner is a recalcitrant litigant and has lost interest in the present litigation. Hence, this CRLMC stands dismissed for non-prosecution. Interim order dated 15.11.2011 passed by this Court stands vacated. 5.

A copy of this order be communicated to the Court below forthwith.
