Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 24.12.2021 in connection with Kissannagar P.S. Case No. 81 of 2020 corresponding to G.R. Case No. 1110 of 2020 pending in the court of learned J.M.F.C. (R), Cuttack for the alleged commission of offence under Sections 498(A)/306/304(B)/34 of IPC read with Section 4 of the Dowry Prohibition Act.

The petitioner is the husband of the deceased. It is alleged that the petitioner and his family members used to subject the deceased to mental and physical cruelty, which she related to her parents on several occasions. Ultimately, the deceased is said to have committed suicide.

Considering the nature of allegations and the existence of

materials prima facie in support thereof, I am not inclined to allow the prayer for bail at this stage, which is therefore rejected. It is however open to the petitioner to renew his prayer after examination of the informant and Raju Mallik during trial. 6.

The BLAPL is accordingly rejected.
