This matter is taken up by virtual/physical mode. 2.
The Petitioner is an exclusive privilege holder of Mallick IMFL Restaurant ON shop at Janha Chhack, Dhaneswar, Dolipur, Jajpur.
By filing the present petition, he is raising a grievance regarding the proposal to permit the shifting of Gunjan IMFL Restaurant ON shop license belonging to Janmejay Baral/ Opposite Party No.5 from his area Ward No.14 of Vyasanagar Municipality, Jajpur Road to the assigned area of the ON shop of the Petitioner. 3.
At the time of hearing, counsel for the Opposite Party No.5 states that the proposal has been rejected vide Memo dated 31st March, 2022 passed by the Excise Commissioner, Odisha, Cuttack,
// 2 // which has been taken on record and therefore, the present writ petition has become infructuous.

In response, Mr. Arun Kumar Patra, counsel for the Petitioner concedes that nothing survives in the present writ petition.

In view of the above, the writ petition stands dismissed as infructuous.
