This matter is taken up through hybrid mode.

Mr. P. Dash, learned counsel on instruction of Mr. S.K. Dash, learned counsel appears alongwith the Appellant. The Appellant has stated that, she has filed a matrimonial suit under Section 13(1) of the Hindu Marriage Act, 1955 seeking dissolution of marriage, which was solemnized on 20.06.2006 between the parties. In view of discovery a few facts, she was persuaded to file the said suit for divorce. Hence, in the emerged circumstances, she is not inclined to proceed with this appeal, which has emerged from a proceeding instituted under Section 9 of the Hindu Marriage Act seeking restitution of conjugal rights.

We do not find any impediment to allow the Appellant withdraw this Appeal. Accordingly, the appeal stands dismissed as withdrawn.
