This matter is taken up through hybrid mode.

Mr. A.N. Dash, learned counsel appears on instruction of Mr. B. Baral, learned counsel for the Petitioner. 3.

Mr. Dash, learned counsel has submitted that in the separate writ petition filed by the management, the Executive Engineer, Lift Irrigation Division, Kendrapara, against the same award, this Court has modified the award on due scrutiny by order dated 06.01.2017 to Rs.50,000/- from Rs.1,00,000/- the amount which was directed to be paid by the Labour Court.

Mr. Dash, learned counsel, appearing for the Petitioner has submitted that the Petitioner in view of the above development would like to withdraw this writ petition. However, Mr. Dash, learned counsel has requested us to direct

the Opposite Party No.2 to make payment of the modified sum, as noted above forthwith. But, we are not aware whether the Opposite Party No.2 has paid the said modified amount, in as much as, the said order was passed on 06.01.2017 in W.P.(C) No.9711 of 2015. If the said order has not been complied with, the Opposite Party No.2 is directed to comply the same within a month from today.

This writ petition stands disposed of as withdrawn subject to the direction, as aforementioned.

Mr. J.P. Pattnaik, learned Government Advocate appears for the Opposite Party No.1.
