This matter is taken up through hybrid mode.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the impugned F.I.R. vide Barbil P.S. Case No.60 of 2010 and the criminal proceeding in G.R. Case No.174 of 2010, pending in the file of the learned J.M.F.C., Barbil.

Learned counsel for the Petitioner submits that he has no instruction in the matter from his client.

Considering the submission of the learned counsel for the Petitioner and the fact that the case is the year 2011 where no interim order was passed, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter. 5.

Hence, this CRLMC stands dismissed for non-prosecution. (S. Pujahari) Judge DA
