1. This matter is taken up by Hybrid mode.

Order No.

2. This application under Section 482 Cr.P.C. has been filed by the Petitioners with a prayer to quash the FIR in connection with Gop P.S. Case No.131 of 2009 corresponding to G.R. Case No.531 of 2009 pending in the court of learned J.M.F.C., Nimapara.

3. It appears that this case is of the year 2013. Defect pointed out by the S.R. has not yet been removed. Though notice has been issued to Opposite Party No.2 vide order dated 17.11.2014, but no one appeared for the said Opposite Party No.2 till date.

4. Learned counsel for the Petitioners submits that this matter arises out of a marital discord. Petitioner No.2 and Opposite Party No.2 are living as husband and wife as such FIR may be quashed but I am not inclined to quash the same.

5. Accordingly, this CRLMC stands dismissed.

6. However, liberty is given to the Petitioners to approach this Court if charge sheet has been filed against them in the aforesaid case.
