1. This matter is taken up through hybrid mode. Order No.

2. The writ petition has been filed by the petitioners, who are the defaulting borrowers having availed three loans from the erstwhile United Bank of India, at present merged with the Punjab National Bank. The petitioners have challenged the e-auction sale notice, dated 31st December, 2021, published in the English daily "The Statesman", fixing the date of auction 31st January, 2022.

3. Mr. Ghose, learned counsel for the Bank upon instruction submits that the scheduled e-auction has failed due to non-participation of the bidders on 31st January, 2022. For the said reason it is also agreed by the learned counsel for the petitioners that the writ petition challenging the e-auction dated 31st January, 2022 has become infructuous.

5. Accordingly, the writ petition is dismissed as infructuous.
