Mr. T. Mishra, learned counsel for the petitioner contended that since the period of tender has already been over by efflux of time, the writ petition has become infructuous. However if any cause of action still subsists as per the terms and conditions of the tender, the petitioner may be given liberty to pursue his remedy before the appropriate forum.
