ORDER

01.08.2022 04.

1. A preliminary counter affidavit was filed way back on 22nd January, 2014 simply stating that the competent authority is in seisen of the matter without stating whether the previous orders passed by this Court have actually been complied with or not.

2. The plea of the petitioners is for enhancement of compensation in terms of Section 28(A)(1) of the Land Acquisition Act, 1894. It appears from the short counter affidavit that the Special Land Acquisition Officer (SLAO), R.I.P., Baghuabol, Talcher, District Angul has already initiated proceedings in that regard pursuant to an order passed by this Court on 11th January, 2010 in W.P.(C) No.18918 of 2009 filed by these very Petitioners.

3. A direction is accordingly issued that if not already done, the aforementioned Land Acquisition Officer, Rengali Irrigation Project (Opposite Party No.4) will pass appropriate orders after

hearing the representatives of the Petitioners within a period of eight weeks from today.

4. For the above purpose, the representatives of the Petitioners will appear before the Opposite Party No.4, i.e., the SLAO, R&R Officer, R.I.P., Baghuabol, Talcher, Dist. Angul on 12th September, 2022 at 3 pm with a downloaded copy of this order. Thereafter he will pass appropriate orders thereon within a period of eight weeks and in any event not later than 5th December, 2022.

5. If aggrieved, it will be open to the Petitioners to seek appropriate remedies in accordance with law.
