1. Learned counsel for the Petitioner seeks leave to withdraw the present writ petition with liberty to file an appeal against the impugned assessment order in accordance with law.

2. The writ petition is disposed of as withdrawn with liberty as prayed for. If the appeal is filed not later than 1st February, 2023 accompanied by an application for condonation of delay explaining the delay on account of pendency of the present petition, it will be considered by the Appellate Authority in accordance with law. The Court clarifies that it has not expressed any view in the matter.

3. The original annexures be returned to the Petitioner subject to being substituted with attested photocopies thereof.
