This matter is taken up through video conference. 2.
Heard learned counsel for the Parties.

This is a Writ Petition involving a direction for auctioning the vehicle bearing Regn. No.OD 06 C 1615 (Swift Dezire Diesel VDI Car), vide Annexure-4. For clear pleading in the Writ Petition that there is completion of OR Case No.88D of 2020/21 and there is no further challenge by the Petitioner being the Owner involving such vehicle any further, this Court finds, there may not be any legal impediment in auctioning the vehicle involved dependent on the outcome in the said Case. This Court finds force in the submission of the learned counsel for the Petitioner. For the opinion of this
// 2 // Court, in the event of early auction, the vehicle involved may be fetching good price and there may be avoiding of further damage to the vehicle.

It is keeping in view, this Court in disposal of the Writ Petition observes, provided there is no legal impediment by way of stay involving OR Case No.88D of 2020/21, all attempts should be made by the competent authority for auctioning the vehicle involved herein by undertaking the exercise within a period of one and half months from the date of communication of this order by the Petitioner.

As restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the Parties may utilize a printout of the order available in the High Court's Website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court's Notice No.4587 dated 25th March, 2020, modified by Notice No.4798 dated 15th April, 2021 and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
