Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 08.01.2022 in connection with Out OIC of Excise Station Cuttack-III Phulnakhara PR Case No. 100/2021 corresponding to 2(a)CC Case No.2 of 2022 pending in the Court of learned J.M.F.C., Jharsuguda for the alleged commission of offence under Section 21(b) of NDPS Act.

Considering the submissions, materials on record, the period of detention in custody and the fact that the seized contraband is less than commercial quantity being 45 grams of brown sugar, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
