Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 04.10.2021 in connection with Kantabanjhi P.S. Case No. 229 of 2021 corresponding to G.R. Case No. 479 of 2021 pending in the court of learned J.M.F.C., Kantabanjhi for the alleged commission of offence under Section 395 of IPC read with Section 25 of Arms Act.

Considering the submissions made, the materials on record, the period of detention already undergone, fact of submission of charge sheet and the fact that similarly placed co-accused persons, namely, Bijaya Kumar @Lilu Padhan and Boudha Majhi have been released on bail by this Court in BLAPL No. 11632 of 2021 and BLAPL No. 201 of 2022 respectively, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may

deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.
