CRLMC No.2768 of 2016 Sanjit Kumar Mohapatra ....

Petitioner Mr. S.K. Samantaray(2), Advocate -versusState of Orissa and others ....

Opp. Parties Mr. S.S. Pradhan, AGA Mr. A.P. Bose, Advocate(O.P.2&3)

CORAM:

JUSTICE G. SATAPATHY Order No.

ORDER

01.11.2022 03.

1.

This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

2.

None appears for the petitioner at the time of call, so also no one had appeared on the last occasion on 12.10.2022. However, Mr. A.P. Bose, learned counsel for the opposite parties no.2 and 3 was present today also on last date.

3.

Learned counsel for the opposite parties no.2 and 3 brings it to the knowledge of the Court that the petitioner has challenged the order passed by the learned Judge, Family Court, Balasore in C.R.P. Case No.335 of 2015 directing issuance of N.B.W. against the petitioner and that order was passed way back on 16.03.2016.

4.

In view of the aforesaid facts and especially when no one had appeared today and on the last date for the petitioner, it pre-supposes that the petitioner is not interested to prosecute the matter. 5.

Hence, the CRLMC stands dismissed.
