1. This matter is taken up through virtual mode.
2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.
3. The Petitioner is in custody in connection with Jeypore Sadar P.S. Case No.222/2020 corresponding to T.R. Case No.82/2020 pending in the court of learned Sessions Judgecum-Special Judge, Koraput for the alleged commission of the offence under Section 20(b)(ii)(C)/29 of the NDPS Act.
4. It is alleged that the Petitioner and five other persons, most of whom belong to Andhra Pradesh, were transporting
// 2 // contraband ganja weighing more than 200 Kgs. when they were apprehended by the Police. Though it is stated that the Petitioner is innocent and has no nexus with the occurrence yet, the materials on record prima facie show his involvement in the occurrence.
5. Considering the above facts as also the fact that the seized contraband is more than commercial quantity, I am not inclined to allow the prayer for bail, which is therefore rejected. (Sashikanta Mishra) AKB Judge
