Mr. B. Singh, learned Counsel for the Appellants and Mr. G.P. Dutta, learned Counsel for the Respondent No.2, along with representative of the Company are present.

The judgment dated 13.12.2012, passed by the court of learned 3rd MACT, Balasore, in MACT Case No.143/46 of 2009/2011 is under challenge, vide which a compensation amount of Rs.9,47,500/- with interest at the rate of 7.5% per annum from the date of filing of the case i.e.17.07.2009 was awarded in favour of the Appellants and the said amount has already been paid to the Appellants.

The Appellants have filed this Appeal for enhancement of the said compensation amount.

Learned Counsels for the Parties submit that matter has been settled amicably and to the said effect, a joint Memo has been filed today, which be kept on record.

In view of such submission of the Parties and the joint Memo, the MACA stands disposed of enhancing the compensation amount further for
an amount of Rs.3,50,000/-(Rupees Three lakh fifty thousand only) consolidated, as agreed by the parties, to be deposited within eight weeks from the date of production of the certified/free copy of this Order before the Court below.

On deposit of the enhanced amount, as agreed by the parties, the same shall be disbursed in favour of the Appellants/Claimants in terms of the proportion/direction given by the court below. 8.
Needless to mention here that since this Order has been passed in the 4th National Lok Adalat, no Court Fee is payable. 9.
