This matter is taken up by video conferencing mode. 2.

The petitioner has filed this writ petition seeking direction to the opposite parties to assign the position of the petitioner at appropriate place in the final gradation list of the Jr. SES teachers treating his deemed date of appointment as on 26.08.1992 instead of 13.08.1996 by taking into account 50% of service rendered by him in the aided school prior to take over i.e. 07.06.1994 i.e. from the date of his initial appointment i.e. 15.1.1990 as per Rule-27 of the Odisha SubOrdinate Education (Method of Recruitment and Condtiions of Service) Rules, 1993 as amended on 20.05.2006. 3.

In course of hearing, learned counsel for the petitioner states that the petitioner has already made representation before opposite party no.2 vide Annexure-13, and the same may be directed to be disposed of within a stipulated time taking into consideration Annexure-7 and 10 within a stipulated time, to which learned State Counsel has raised no

objection.

As agreed by learned counsel for the parties, without expressing any opinion on the merits of the case, this writ petition stands disposed of directing opposite party no.2 to consider the representation filed by the petitioner under Annexure-13 taking into consideration Annexure-7 and 10, and pass a reasoned and speaking order as expeditiously as possible, preferably within a period of three months from the date of receipt of the certified/authenticated copy of this order.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed, vide Court's Notice No.4587 dated 25th March, 2020, as modified by Court's notice no. 4798 dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
