Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking direction to the opposite party no.3 to accept VR application dated 01.09.2021 as per Legal Fiction under proviso to Rule-42(2) of the Odisha Civil Services (Pension) Rules, 1992 and to declare that the VR application of the petitioner shall become effective on expiry of 03 months period on 01.12.2021 as per the aforesaid Rules, 1992 and issue further direction to opposite party no.3 to finalize the pension and other retirement benefits of the petitioner in revised scale of pay in the rank of Senior Revenue Assistant with due sanction of pending ACP/RACP/MACP and other financial benefits.

In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made representation to the opposite party no.3 vide Annexure-8 and the same may be directed to be disposed of within a stipulated time, to which learned State counsel has raised no objection. 5.
As agreed to by learned counsel for the parties, this Court,
without expressing any opinion on the merits of the case, disposes of the writ petition directing the opposite party no.3 to consider the representation filed by the petitioner vide Annexure8 and pass appropriate order in accordance with law, within a period of three months from the date of production of authenticated/certified copy of this order.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020 as modified by Court's Notice No. 4798 dated 15th April, 2021 and Court's office order circulated vide Memo Nos. 514 and 515 dated 7th January, 2022.
