This application under Section 482 Cr.P.C. has been filed by the Petitioner for quashment of the FIR in connection with Balasore Town P.S. Case No.44 of 2009 corresponding to C.T. Case No.157 of 2009 pending in the court of learned Asst. Sessions Judge (Special Track Court), Balasore on the ground that both the Petitioner and the victim are living as husband and wife.

The allegation of the prosecution reveals that at the time of occurrence the victim was minor.

Considering the facts and the submissions made, this Court is not inclined to quash the FIR on the ground of compromise as both of them are living as husband and wife.

Accordingly, this CRLMC stands dismissed.
