Heard learned counsel for the petitioner and learned counsel for the State.

Instant petition under Section 482 Cr.P.C. is filed by the petitioner for quashing of the order of cognizance dated 25th April, 2016 passed in G.R. Case No.123 of 2016 pending before the court of learned S.D.J.M., Sundargarh.

However, it is submitted by the learned counsel for the petitioner that in the meantime, the charge has been framed and trial has also commenced and some witnesses from the side of the prosecution has also been examined and hence, matter has become infructuous.

However, a prayer is made to raise grounds whatever before the learned court below at the time of trial with direction to the learned court below to expedite the trial. 5.

Considering the above prayer, the CRLMC stands disposed of with a liberty granted to the petitioner to raise all the grounds

during trial and the learned S.D.J.M., Sundargarh requested to expedite the trial and ensure its disposal of the case preferably within six months from the date of receipt of the copy of the above order.

An urgent certified copy of this order be granted as per rules.
