1. On 28th June, 2017 a show cause affidavit was filed by the Opposite Parties explaining inter alia in paras 5, 6 & 7 as under:
"5. That although efforts were made to complete the enquiry within the stipulated time, it could not be completed as proper co-operation was not received from the petitioners. For enumeration and identification of the extended families of the original families the enquiring officials had to move from door to door. Since all the petitioners were not staying in one place and the whereabouts of many others were not available and even some of the petitioners working outside the State, the enquiry could not be completed within the time specified by the Hon'ble Court, although prompt steps and all sincere attempts were taken by field functionaries.
6. That after conducting enquiry, the Collector, Mayurbhanj furnished a proposal of 54 extended families for rehabilitation assistance to the Government in Departmental of Water Resources, relating to village Hatibari.
Out of this Government sanctioned Rs.43,68,000/- against 6
// 2 // eligible extended families and rejected 8 cases as ineligible. Government returned balance 40 cases for further scrutiny and resubmission as per the prevalent Government policy.
Sanction of rehabilitation assistance amount was released vide Government in Department of Water Resources letter No.15324/WR dated 29.05.2013 and No.15331/WR dated 29.05.2013.
7. That further enquiry in respect of the cases returned by the Government was conducted and resubmitted to Government.
Thereafter Government sanctioned Rs.70,56,225/- against 14 extended families of Hatibari village vide Order No. 12523/WR dated 08.06.2015.
Again Government, not being satisfied with the enquiry, returned the balance 26 cases to the Spl.LAO & R.O, Karanjia for further scrutiny. On resubmission, Government sanctioned 13 out of balance 26 cases of extended families for an amount of Rs.25,92,085/- of village Hatibari, vide Order No. 12474/WR.dt.25.07.2017. The balance 13 cases of extended families were found to be ineligible by Government in Department of Water Resources and were rejected. With this the claims of all the eligible petitioners have been covered relating to village Hatibari. The claims of those petitioners which were found to be ineligible after scrutiny, have been rejected by Government."
2. This Court has heard the submissions of learned counsel for the parties. The Court is satisfied that there has been no wilful disobedience of the order of this Court. If the Petitioner is aggrieved by the above orders of the Opposite Party, it will be open to the Petitioner to seek other appropriate remedies in accordance with law.
