Heard Mr. Mohapatro, learned counsel for the Petitioner and Mr. Dash, learned Additional Government Advocate. 3.
According to Mr. Mohapatro, the Petitioner is aggrieved by inaction of the authorities in sanctioning and disbursing compensation amount to which he is entitled to under Section 28-A of the Land Acquisition Act, 1894. In this context, he submits that the though Opposite Party No.3-Special Land Acquisition-cum-R & R Officer, Lower Indra Irrigation Project, Khariar, Nuapada has recommended the case of the Petitioner vide letter dated 2nd November, 2021 under Annexure-3 to Opposite Party No.2- Director (R & R) & Ex-Officio Additional Secretary to Government, Water Resources Department, Odisha, Bhubaneswar, however till date nothing has been done in the matter. In such background, he prays that necessary direction may be issued to Opposite Party No.2 to take a decision on the recommendation of Opposite Party No.3 within a specified period.

Considering such submissions, this Court without
// 2 // expressing any opinion on the merits of the case, directs Opposite Party No.2- Director (R & R) & Ex-Officio Additional Secretary to Government, Water Resources Department, Odisha, Bhubaneswar to take a decision on the recommendation made under Annexure-3 by Opposite Party No.3 in accordance with law within a period of two months from the date of receipt of a copy of this order and communicate result of such exercise to the Petitioner.

With the aforesaid direction, the writ petition is disposed of.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587 dated 25th March, 2020, modified by Notice No.4798 dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
